Under QLD legislation, these certificates are required at different intervals: every two years for non-shared pools and annually for shared pools. Before leasing a property with a non-shared pool, a current Pool Compliance Safety Certificate must be provided. If a certificate is not available, a Form 36 Notice of no certificate must be issued to the potential buyer or lessee.
For properties with shared pools, similar regulations apply. A Form 36 must be provided to both the body corporate and the QBCC before completing any property transaction, with the certificate to be obtained within 90 days post-settlement or lease commencement.
